Appointment of the Governor:
Article 153 of the Constitution mandates the appointment of a Governor for each state. However, the Seventh Constitutional Amendment allows a person to hold the position of Governor for two or more states simultaneously, as we see with some current Governors. The President of India appoints the Governor for a term of 5 years.
Qualification of Governor:
To qualify for the position of Governor, an individual must:
- Be an Indian citizen.
- Be at least 35 years old.
- Not hold any office of profit when elected as Governor.
- Meet all the qualifications required for a member of the State Legislative Assembly.
Powers of Governor in India
The Governor appoints the Chief Minister. The Council of Ministers is formed on the advice of the Chief Minister. And work only on the advice of the Council of Ministers. The Governor is the Chancellor of all the universities of the state. The Governor also appoints the Advocate General of the state, Chairman and members of the Public Service Commission. The Finance Bill cannot be presented in the Assembly without the permission of the Governor. No bill becomes law without the permission of the Governor. If the Governor wishes, he can stop the bill or return it or send it to the President. But if the bill is returned by the Governor and the same bill is passed by the Assembly without any amendment, then the Governor cannot stop that bill, he has to approve it.
Governor Salary in India
State governors receive a monthly salary of Rs 3,50,000, while the Prime Minister earns Rs 1,00,000 per month. The President’s salary is Rs 5,00,000, and the Vice President earns Rs 4,00,000. Governors also receive various allowances, which vary by state, along with a leave allowance. They receive allowances for government accommodation maintenance, and access to free medical care in government hospitals. Governors can also use vehicles for official duties at no cost, and receive a travel allowance for vacations. Additionally, they receive several other allowances.
Can a Governor be arrested or detained?
Section 135 of the Code of Civil Procedure provides immunity from arrest to certain high-ranking officials in civil cases. This includes the Prime Minister, Union Ministers, members of the Lok Sabha and Rajya Sabha, Chief Minister, and members of the Legislative Assembly and Legislative Council. Approval from the Speaker or Chairman of the House is required for their arrest or detention, and they cannot be arrested or detained 40 days before, during, and 40 days after the session. They also cannot be arrested or detained inside the Parliament, Assembly, or Council premises without the Speaker or Chairman’s order.
Article 361 of the Constitution grants similar immunity to the President and Governors. They cannot be arrested or detained while in office, and no court can issue orders against them. However, this immunity does not apply after they leave office.
Governors play a crucial role in maintaining communication and relations between the central and state governments, especially when they are ruled by different parties, ensuring smooth coordination.
